Call on the UN to Investigate Serious Human Rights Violations in Mozambique

At the end of November, the organisations WALHI South Sulawesi (part of Friends of the Earth) and Both ENDS filed a formal complaint with the Dutch export credit agency Atradius DSB. Despite the warnings from local communities for the negative consequences of a land reclamation project in the bay of Makassar, Atradius DSB advised the Dutch government to provide dredging company Boskalis with insurance for the execution of the project. The consequences for the fish stock, the beach and the lives of thousands of small-scale fishing communities are severe. Atradius DSB has not sufficiently investigated these harmful consequences beforehand.

At the end of last week, oil and gas company Total announced that, through its export credit insurer Atradius DSB, the Dutch government is participating in a funding package for a controversial gas extraction project in Mozambique. The project, in which various Dutch and foreign companies are involved, is having a deep impact on the local population and the natural environment in the area. Which Dutch companies the government will be insuring is not yet clear.

At the beginning of this year, the Dutch government provided Dutch companies with export insurance worth 903 million euros to enable them to participate in a gigantic natural gas project in the north of Mozambique. Together with partners from Mozambique and the Netherlands, Both ENDS has been conducting a dialogue with export credit agency Atradius DSB and the responsible Ministries of Finance and Foreign Affairs on the possible financial, environmental and social risks of the gas project.

Amsterdam, 19 May 2021 – On 25 March, a day after violent attacks in northern Mozambique, the Dutch state decided to provide dredging company Van Oord with export credit insurance worth 900 million euros for its activities in the country. The company is conducting dredging operations for a highly controversial gas project that, according to Mozambican interest groups, is playing a prominent role in the escalating violence in the region. Civil society organisations Both ENDS, Milieudefensie and Oil Change International and their Mozambican partners are alarmed about the situation and have called the Dutch government and Dutch export credit agency Atradius DSB to account.

On Friday 14 March, the French Public Prosecutor's Office announced that it would launch an official investigation into TotalEnergies’ involvement in involuntary manslaughter during the attacks on Palma, the location of their LNG project. This umpteenth abuse makes it clear that the Netherlands cannot in any way provide public support for this project. 

The official Dutch export credit agency Atradius DSB in November 2010 announced to consider support for the expansion of the Panama canal. According to the local Gatún Lake Defense Committee the project in its current shape will not only be uneconomic, but also very harmful to the environment. Recently Both ENDS informed Atradius DSB of these concerns. The ECA is currently assessing the significance of these concerns for its eventual decision to issue an insurance policy.

The port of Suape in Brazil is currently being expanded and dredged, with damaging implications for the local population and environment. The Dutch dredging company Van Oord executes a large proportion of the dredging-work, supported by export credit insurance from the Dutch export credit insurance agency Atradius DSB. Correspondent Katy Sherriff has made several reports in the area, which will be aired on Dutch radio in ‘Reporter’ on Sunday. Her story will be accompanied by live commentary from the studio, from Dutch political party PvdA-member Jan Vos and Both ENDS’ own Wiert Wiertsema.

Atradius Dutch State Business (Atradius DSB) remains responsible for observing social, environmental and human rights, also after providing export credit insurance. That is the conclusion of the Dutch National Contact Point (NCP) for the OECD Guidelines in its final statement, which was published today. Both ENDS issued a press release about this.

Dutch export credit agency Atradius DSB announced yesterday that it is to provide export credit insurance worth 1,5 billion euros to Dutch dredging company Boskalis for a controversial land reclamation project in the Philippines. According to Dutch and international organisations, including Both ENDS, CARE Netherlands, IUCN NL, Kalikasan PNE and Oceana Philippines, the award of export credit insurance for this project runs contrary to the Netherlands' ambitions in the areas of environment and corporate social responsibility (CSR).

Abuses committed during the construction of an airport in the Philippines show the urgent need for legislation on corporate social responsibility here in the Netherlands, say Murtah Shannon of Both ENDS and Maartje Hilterman of IUCN NL on behalf of a coalition of Dutch and Philippine organisations.

Both ENDS is shocked by the dramatic news in the past days coming from Palma, Cabo Delgado, Mozambique. Our thoughts go to those who lost their lives or who are still missing, and their loved ones. Both ENDS is in close contact with our local partners to support them wherever we can. Many people are still missing, among whom members of farmers union UPC.

In the final days of March, the human rights council of the United Nations declared they will install an 'Independent Expert on Human Rights and Environment'. The effect of climate change on human lives is becoming more obvious, and by making this decision, the council acknowledges the importance of the relationship between human rights and the environment. This is good news right before the Rio+20 conference in June; Both ENDS and other civil society organisations are advocating incorporation of human rights into sustainable development policy.

As we celebrate both the 30th anniversary of the UN Declaration on the Right to Development (December 4th) and Human Rights Day (December 10th), Both ENDS joins with communities and civil society groups around the world to call on development finance institutions, governments, and businesses to take 3 steps to stand up for Human Rights in development.

An Open Letter to States and Development Financiers on the need to ensure that development interventions support the realization of human rights, safeguard human rights defenders and guarantee meaningful public participation

We are shocked and alarmed by the news that the Philippine government has declared a list of 600 people to be communist terrorists. On the list are mostly indigenous leaders, environmental activists and human rights defenders. Among them are some of our partners, and we are deeply worried about them and the other people on this list.

A report published yesterday by Amnesty Central America shows that the plans for a new canal leads to numerous violations of human rights in Nicaragua. And that's even before the works have started. Many organisations therefore protest against the canal, supported by Both ENDS.

This week, from 12 until 16 February, fourteen indigenous leaders and human rights defenders from forest countries came to the Netherlands to call upon Dutch policy makers to take serious action against human rights abuses, land grabbing and further deforestation in relation to large scale agriculture, timber logging and mining. The Dutch harbours of Rotterdam and Amsterdam receive enormeous amounts of soy and palm oil, both for the Dutch market and for further transport into Europe and elswhere.

On 23 July 2020 a global network of NGOs working to strengthen corporate accountability for environmental destruction and human rights abuses, including Both ENDS, published an open letter to European Commission DG Justice Commissioner Reynders. The letter is a response to his recent commitment to propose legislation in 2021 on both corporate due diligence and directors’ duties as part of an initiative on sustainable corporate governance.
